KULLANIM KOŞULLARI VE SON KULLANICI LİSANS SÖZLEŞMESİ (EULA)

Bu Kullanım Koşulları ve Son Kullanıcı Lisans Sözleşmesi (“Sözleşme”), Wybe mobil uygulamasını (“Uygulama”) indiren, kuran veya kullanan kişi (“Kullanıcı”) ile Uygulama’nın hak sahibi (“Hizmet Sağlayıcı”) arasında akdedilmiştir. Uygulamayı kullanarak bu şartların tamamını kabul etmiş sayılırsınız.

1. GENEL ŞARTLAR VE YAŞ SINIRI

1.1. Uygulamayı kullanmak için en az 18 yaşında olmanız gerekmektedir. 18 yaş altındaki bireylerin Uygulamayı kullanması kesinlikle yasaktır.

1.2. Hizmet Sağlayıcı, yaş sınırına uymadığı tespit edilen kullanıcıların hesaplarını bildirim yapmaksızın ve iade yükümlülüğü olmaksızın kalıcı olarak kapatma hakkını saklı tutar.

2. KULLANICI HESAPLARI VE GÜVENLİK

2.1. Kullanıcı, hesap oluştururken verdiği bilgilerin doğruluğunu taahhüt eder.

2.2. Hesap güvenliğinden tamamen Kullanıcı sorumludur. Şifrenin yetkisiz kişilerce kullanımı neticesinde doğabilecek zararlardan Hizmet Sağlayıcı sorumlu tutulamaz.

3. KULLANICI TARAFINDAN OLUŞTURULAN İÇERİK (UGC) VE DAVRANIŞ KURALLARI

Uygulama, kullanıcıların birbirleriyle etkileşime girmesine ve içerik paylaşmasına izin vermektedir. Bu kapsamda "Sıfır Tolerans" politikası uygulanır:

3.1. Yasaklı İçerikler: Müstehcenlik, çocuk istismarı, nefret söylemi, ırkçılık, tehdit, taciz, kişisel verilerin izinsiz paylaşımı ve yasa dışı faaliyetlerin teşviki kesinlikle yasaktır.

3.2. Moderasyon: Hizmet Sağlayıcı, içerikleri manuel veya Yapay Zeka (AI) destekli sistemlerle denetleme hakkına sahiptir. Kurallara aykırı içerikler derhal kaldırılır.

3.3. Raporlama ve Engelleme: Kullanıcılar, kural ihlali yapan diğer kullanıcıları Uygulama içi mekanizmalarla raporlayabilir veya engelleyebilir. Hizmet Sağlayıcı, raporlanan içerikleri 24 saat (en geç 7 iş günü) içinde inceleyerek gerekli aksiyonu almayı taahhüt eder.

4. ÜCRETLİ HİZMETLER VE İADE POLİTİKASI

4.1. Uygulama içindeki dijital ürünler, abonelikler veya krediler; elektronik ortamda anında ifa edilen hizmetler kapsamındadır.

4.2. Cayma Hakkı İstisnası: 6502 sayılı Tüketicinin Korunması Hakkında Kanun uyarınca, dijital içeriklerin kullanımıyla birlikte "cayma hakkı" sona erer. Bu nedenle satın alınan dijital ürünler için iade yapılmaz.

4.3. Kural İhlali Durumunda İade: Kullanıcının bu Sözleşmeyi veya Topluluk Kurallarını ihlal etmesi nedeniyle hesabı kapatılırsa; satın alınmış abonelikler, krediler veya sanal ürünler için herhangi bir ücret iadesi yapılmayacaktır.

5. HİZMETİN KAPSAMI VE SORUMLULUK SINIRI

5.1. Uygulama "olduğu gibi" sunulmaktadır. Hizmet Sağlayıcı, kesintisiz hizmet veya hata içermeme garantisi vermez.

5.2. Kullanıcılar arasındaki iletişimden, paylaşılan içeriklerden veya bu içeriklerin doğruluğundan Hizmet Sağlayıcı sorumlu tutulamaz. Tüm hukuki sorumluluk içeriği üreten kullanıcıya aittir.

6. FİKRİ MÜLKİYET HAKLARI

Uygulamanın tasarımı, yazılımı, logoları ve tüm teknik altyapısı Hizmet Sağlayıcı’nın mülkiyetindedir. Uygulamanın kopyalanması, kaynak kodunun deşifre edilmesi veya tersine mühendislik yapılması yasaktır.

7. SÖZLEŞMENİN FESHİ

Hizmet Sağlayıcı, Kullanıcı’nın bu Sözleşme’deki yükümlülüklerinden herhangi birini ihlal etmesi durumunda, sözleşmeyi tek taraflı olarak feshedebilir ve Kullanıcı’nın Uygulama’ya erişimini süreli veya süresiz olarak engelleyebilir.

8. DEĞİŞİKLİKLER VE BİLDİRİM

Hizmet Sağlayıcı, bu koşulları dilediği zaman güncelleme hakkına sahiptir. Güncel koşullar Uygulama içinde yayınlandığı andan itibaren geçerlilik kazanır.

9. UYGULANACAK HUKUK VE YETKİLİ MAHKEME

Bu Sözleşme’den doğacak ihtilaflarda Türkiye Cumhuriyeti hukuku uygulanacak olup, yetkili merci Mahkemeleri ve İcra Daireleridir.

TERMS OF USE AND END-USER LICENSE AGREEMENT (EULA)

This Terms of Use and End-User License Agreement (“Agreement”) is entered into between the individual who downloads, installs, or uses the Wybe mobile application (“Application”) (the “User”) and the rights holder of the Application (the “Service Provider”). By using the Application, you are deemed to have accepted all of these terms and conditions.

1. GENERAL TERMS AND AGE RESTRICTION

1.1. You must be at least 18 years old to use the Application. Use of the Application by individuals under the age of 18 is strictly prohibited.

1.2. The Service Provider reserves the right to permanently terminate the accounts of users found to be in violation of the age limit without prior notice and without any obligation for a refund.

2. USER ACCOUNTS AND SECURITY

2.1. The User undertakes that all information provided during account creation is accurate and up-to-date.

2.2. The User is solely responsible for maintaining account security. The Service Provider shall not be held liable for any damages resulting from the unauthorized use of passwords by third parties.

3. USER-GENERATED CONTENT (UGC) AND CODE OF CONDUCT

The Application allows users to interact and share content. In this context, a "Zero Tolerance" policy is enforced:

3.1. Prohibited Content: Obscenity, child abuse, hate speech, racism, threats, harassment, unauthorized sharing of personal data, and the promotion of illegal activities are strictly prohibited.

3.2. Moderation: The Service Provider reserves the right to monitor content through manual or Artificial Intelligence (AI) supported systems. Content found to be in violation of the rules will be removed immediately.

3.3. Reporting and Blocking: Users may report or block other users who violate these rules using the in-app mechanisms. The Service Provider undertakes to review reported content and take necessary action within 24 hours (and no later than 7 business days).

4. PAID SERVICES AND REFUND POLICY

4.1. Digital products, subscriptions, or credits within the Application are considered services performed instantly in an electronic environment.

4.2. Exception to the Right of Withdrawal: Pursuant to Law No. 6502 on Consumer Protection, the "right of withdrawal" expires once the use of digital content has commenced. Therefore, no refunds will be issued for purchased digital products.

4.3. Refunds in Case of Rule Violation: If a user’s account is terminated due to a violation of this Agreement or Community Guidelines, no refunds will be issued for any purchased subscriptions, credits, or virtual items.

5. SCOPE OF SERVICE AND LIMITATION OF LIABILITY

5.1. The Application is provided on an "as is" and "as available" basis. The Service Provider does not guarantee uninterrupted service or that the software will be error-free.

5.2. The Service Provider cannot be held responsible for interactions between users, shared content, or the accuracy of such content. All legal liability rests with the user who generated the content.

6. INTELLECTUAL PROPERTY RIGHTS

The design, software, logos, and all technical infrastructure of the Application are the exclusive property of the Service Provider. Copying the Application, deciphering the source code, or performing reverse engineering is strictly prohibited.

7. TERMINATION OF AGREEMENT

The Service Provider may unilaterally terminate this Agreement and block the User's access to the Application, temporarily or permanently, if the User violates any obligations set forth in this Agreement.

8. AMENDMENTS AND NOTIFICATION

The Service Provider reserves the right to update these terms at any time. Updated terms become effective immediately upon being published within the Application.

9. GOVERNING LAW AND JURISDICTION

In case of any disputes arising from this Agreement, the laws of the Republic of Turkey shall apply, and the [Local] Courts and Execution Offices shall have exclusive jurisdiction.
